These Terms apply when you use www.watchbay.com.au or place an order with us.

WatchBay is operated by Arcorn Pty Ltd, ABN : 71621517566, of PO BOX – 5596, Studfield, Vic – 3512 (“WatchBay”, “we”, “us”, “our”).

By accessing this website or placing an order, you agree to these Terms. If you don’t agree with them, please don’t use the website.

1. Changes to these Terms

We may update these Terms from time to time. The Terms that apply to your order are the ones published at the time you place it — later changes won’t be applied retrospectively to orders already made. Where we make a material change, we’ll update the “last updated” date above and, where reasonably practical, note the change on this page.

2. Orders and acceptance

All orders are subject to acceptance and availability. A contract for sale is formed once we confirm and dispatch your order.

We may refuse, cancel or limit an order where there is a genuine reason to do so — for example suspected fraud, a pricing or listing error, stock unavailability, or breach of these Terms. If we cancel an order after payment has been processed, we’ll refund you in full to the original payment method.

3. Pricing and product information

All prices are in Australian Dollars (AUD) and include GST where applicable to Australian orders. Prices may change from time to time, but changes won’t affect orders already confirmed.

We take reasonable care to ensure product descriptions, specifications, pricing and images are accurate. Occasionally errors occur. Where a material error affects your order, we’ll contact you and you may choose to proceed at the correct price or cancel for a full refund.

Product images are indicative. Actual products may vary slightly in colour or appearance due to manufacturing updates or screen differences.

4. Your rights under Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any right or remedy available to you under the Australian Consumer Law or other legislation that cannot be excluded.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Except where the law provides otherwise, our liability in connection with a product is limited, at our election, to replacing the product, repairing it, or refunding the purchase price.

5. Returns

We offer a 15-day change-of-mind return window, subject to the conditions on our Shipping & Returns page. This is offered in addition to, and does not limit, your rights under the Australian Consumer Law.

6. Shipping and risk

We ship within Australia and New Zealand, and to selected international destinations. Depending on stock, orders may be fulfilled from domestic or international warehouses or third-party logistics partners.

Shipping timeframes are estimates. Risk in the goods passes to you on delivery.

We’re not liable for delays or loss arising from events outside our reasonable control — including courier delays, customs processing, incorrect address details supplied at checkout, industrial action, natural disasters, government restrictions or supply chain disruption. This doesn’t affect your rights under the Australian Consumer Law, including where goods are not delivered.

International orders may attract customs duties, import taxes and other charges imposed by the destination country. These are the purchaser’s responsibility and we can’t estimate them.

7. Intellectual property

The content of this website — including text, graphics, layout, branding and design elements — is owned by WatchBay or used with permission, and is protected by intellectual property laws.

Product images, brand names, trademarks and specifications may be supplied by manufacturers, distributors or suppliers, or used to identify genuine products we sell. All third-party trademarks and copyrights remain the property of their respective owners. We don’t claim ownership of them and don’t intend to infringe any rights.

If you’re a rights holder and believe content has been used inappropriately, please contact us at contact@watchbay.com.au and we’ll investigate promptly and remove the material where appropriate.

8. Use of this website

Please don’t use this website for any unlawful purpose, or in a way that could impair its functioning or security, and don’t attempt to gain unauthorised access to any part of it or its systems.

If you submit a review, photo or other content, you grant us a non-exclusive, royalty-free licence to use it for business and promotional purposes. You’re responsible for ensuring anything you submit doesn’t infringe someone else’s rights.

9. Liability

To the maximum extent permitted by law, and subject to clause 4, we exclude liability for indirect, incidental, special or consequential loss — including loss of profits, revenue, opportunity or data — arising from use of this website or purchase of products.

The website and its content are provided on an “as is” and “as available” basis. We take reasonable steps to keep it accurate and secure, but we don’t guarantee uninterrupted or error-free access.

10. Indemnity

You agree to indemnify us against claims, liabilities, damages and reasonable expenses to the extent they are caused by your breach of these Terms, your misuse of the website, or your violation of any law or third-party rights. This does not apply to the extent a claim arises from our own act, omission or breach.

11. Events outside our control

We’re not liable for failure or delay in performing our obligations where it results from events beyond our reasonable control, including natural disasters, acts of government, pandemics, supply chain disruption, courier delays or technical failures.

12. Product safety — button batteries

Some watches contain button or coin batteries, which can cause serious injury if swallowed. Keep them out of reach of children. If ingestion is suspected, contact the Australian Poisons Information Centre on 13 11 26 immediately.

13. Governing law

These Terms are governed by the laws of the State of Victoria, Australia. Disputes are subject to the jurisdiction of the courts of Victoria.

If something’s gone wrong, please contact us first — we’d much rather resolve it directly and quickly.
