If you do not agree with any part of these Terms, you must not use this website. WatchBay reserves the right to update, modify or replace these Terms at any time without prior notice. Your continued use of the website constitutes acceptance of any updated Terms.

By placing an order, you acknowledge that all orders are subject to acceptance and availability. A contract for sale is only formed once your order has been confirmed and dispatched by WatchBay. We reserve the right to refuse, cancel or limit any order at our sole discretion, including but not limited to suspected fraudulent activity, pricing errors, stock unavailability, or breach of these Terms. If an order is cancelled after payment has been processed, a refund will be issued to the original payment method.

All prices are listed in Australian Dollars (AUD) unless otherwise stated and are subject to change without notice. While we take reasonable care to ensure that all product descriptions, specifications, pricing and images are accurate, errors, inaccuracies or omissions may occur. WatchBay reserves the right to correct any such errors and to cancel any order arising from such errors, including pricing errors, even if payment has already been made. In such circumstances, a full refund will be provided. Product images are for illustrative purposes only and actual products may vary slightly in colour, size or appearance due to manufacturing updates or screen display differences.

WatchBay offers a 15-day change-of-mind return period from the date of delivery, subject to the conditions outlined on our Shipping & Returns page. To be eligible, items must be unworn, unused, unaltered, undamaged and returned in original condition with all original packaging, documentation and protective materials. All returns are subject to inspection and approval by the WatchBay team prior to any refund being issued. WatchBay reserves the right to refuse returns that do not meet these conditions. This change-of-mind policy operates in addition to, and does not limit, your rights under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law or other applicable legislation that cannot be excluded. Where a product fails to meet a consumer guarantee under Australian law, you may be entitled to a repair, replacement or refund as provided by law. Except as required by law, WatchBay’s liability in connection with any product is limited, at our discretion, to the replacement of the product, repair of the product, or refund of the purchase price.

WatchBay primarily ships within Australia and New Zealand and may offer international shipping where available. Depending on stock availability, WatchBay may fulfil orders from domestic or international warehouses or third-party logistics partners. Shipping timeframes are estimates only and are not guaranteed. Risk in the goods passes to you upon delivery to the address provided at checkout. WatchBay is not liable for delays, loss or damage arising from events outside our reasonable control, including courier delays, customs processing, incorrect address details supplied by the customer, industrial action, natural disasters, government restrictions or supply chain disruptions.

International orders may be subject to customs duties, import taxes and other charges imposed by the destination country. These charges are the sole responsibility of the purchaser. WatchBay does not control and cannot estimate such charges.

All intellectual property on this website, including text, graphics, logos, layout, branding and design elements, is owned by WatchBay or used under licence and is protected by applicable intellectual property laws. Product images, brand names, trademarks and specifications may be sourced from manufacturers, authorised distributors or official brand materials and are used strictly for identification and promotional purposes. All third-party trademarks and copyrights remain the property of their respective owners. WatchBay does not claim ownership of such materials and does not intend to infringe any intellectual property rights. If any rights holder believes content has been used inappropriately, they are encouraged to contact us and we will promptly investigate and, where appropriate, remove the material.

You agree not to use this website for any unlawful purpose or in a manner that may impair its functionality or security. You must not attempt to gain unauthorised access to any part of the website or its systems. Any reviews, feedback or submissions provided by you may be used by WatchBay on a non-exclusive, royalty-free basis for business and promotional purposes. You are responsible for ensuring that any content you submit does not infringe the rights of any third party.

To the maximum extent permitted by law, WatchBay excludes all liability for indirect, incidental, special or consequential loss or damage, including loss of profits, loss of revenue, loss of opportunity or loss of data arising from the use of this website or the purchase of products. The website and its content are provided on an “as is” and “as available” basis. While we take reasonable steps to maintain the accuracy and security of the website, we do not guarantee uninterrupted access or error-free operation.

You agree to indemnify and hold harmless WatchBay, its directors, employees and affiliates from and against any claims, liabilities, damages or expenses arising from your breach of these Terms, misuse of the website, or violation of any law or third-party rights.

WatchBay shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control, including but not limited to natural disasters, acts of government, pandemics, supply chain disruptions, courier delays or technical failures.

Some watches may contain button or coin batteries which can cause serious injury if swallowed. Keep batteries out of reach of children. If ingestion is suspected, contact the Australian Poisons Information Centre on 13 11 26 immediately.

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes arising in connection with these Terms or the use of this website shall be subject to the exclusive jurisdiction of the courts of Victoria.
